Terms of Service

1. Description of Service

DogRecords is software for managing a dog-training business. It allows users to:

• Manage client and dog information.
• Offer and manage training packages.
• Schedule training classes and document progress.
• Provide clients with access to their training progress if granted by the trainer.

DogRecords is available for individuals and businesses, including professional dog trainers, aspiring trainers, and individuals training their own dogs.

2. Eligibility and Accounts

To use DogRecords, you must be at least 18 years old and able to enter a binding contract. Users must create an account using an email or a Google account and are responsible for keeping their login credentials secure.

DogRecords is not liable for unauthorized access due to failure to secure login information.

3. License and Our Intellectual Property

We grant you a limited, non-exclusive, non-transferable, revocable license to use DogRecords for your own training business or personal use, subject to these Terms.

• DogRecords owns the software, design, trademarks, and documentation.
• You may not copy, modify, reverse engineer, resell, or sublicense the service, except as allowed by law.

4. Prohibited Conduct

You may not:

• Use DogRecords for illegal, abusive, or harmful purposes.
• Send spam or excessive email communications through the service.
• Interfere with the service, attempt to access data you do not have permission to access, or scrape the platform.
• Upload content you do not have the right to use.

We may suspend or terminate an account that violates these Terms.

5. Training Philosophy

DogRecords is committed to ethical, science-based dog training. We support positive reinforcement methods and do not endorse training techniques that rely on fear, pain, or intimidation. Trainers using our platform are expected to follow humane, reward-based training practices that prioritize the welfare of dogs and the safety of their owners.

6. Not Professional Advice

DogRecords is software, not veterinary, medical, legal, or professional dog-training advice. You are responsible for the training methods you use, the communications you send, and the outcomes of your work with clients and dogs.

7. Subscription and Billing

Active use of the DogRecords trainer portal requires a paid monthly subscription, except during a free trial or where we have granted complimentary access.

• The subscription price is $20 per month, billed in U.S. dollars.
• All payments are processed by Stripe, our third-party payment processor. Stripe's terms and privacy policy also apply to payment processing.
• Subscriptions are billed on a recurring monthly basis until canceled.
• By subscribing and providing a payment method, you authorize DogRecords and Stripe to charge that payment method for the subscription fee and any applicable taxes at the start of each billing period.
• Taxes may be added where required by applicable law. The total charged may therefore be higher than the advertised $20 monthly price.
• Fees already paid are not refunded, except where required by law. If you cancel, you keep access through the already-paid period and are not charged for later periods.
• If a payment fails, we or Stripe may retry the charge, and the account may become restricted until the payment is resolved in the Stripe billing portal.

8. Free Trial

Eligible new accounts may receive a 30-day free trial with active use of the trainer portal.

• During the trial, you may create, view, edit, export, and delete business records, subject to these Terms.
• When the 30-day trial ends, continued active use requires a paid subscription.
• If you do not subscribe when the trial ends, your account may become restricted as described in Restricted Access below.

9. Cancellation

You may cancel your subscription at any time.

• To cancel, go to Settings in the trainer portal and select Manage billing. This opens the Stripe billing portal, where you can cancel your subscription.
• Cancellation takes effect at the end of the current paid billing period. You will not be charged for later periods after the cancellation is processed.
• You keep full active access through the already-paid period. After that period ends, the account may become restricted as described below.

You may also delete your account at any time from Settings. Deleting your account cancels any related Stripe subscription.

10. Restricted Access

After a free trial or a paid subscription ends without renewal, or if a payment fails, your account may become restricted. Restricted access lets you keep your existing data and resume a subscription later, but it is not active use of the service.

While your account is restricted, you may:

• View your existing data.
• Export your data.
• Delete data.
• Delete your account.
• Reactivate full access by starting or resuming a paid subscription.

Restricted access does not allow you to:

• Create new business records.
• Edit existing business records.

11. Your Content and Privacy

You own the information you enter into DogRecords. You grant us a limited license to host, process, display, and transmit that information as needed to provide the service, including sending emails and sharing records you choose to share.

• You are responsible for having permission to enter information about clients, dogs, and other people.
• You are responsible for communications you send through DogRecords, such as homework, class notifications, and intake messages.

How we handle personal information is described in our Privacy Policy.

12. Optional AI Features

Some features use artificial intelligence provided by OpenAI. If you use them, the content you submit, such as text, audio, or images, may be sent to OpenAI to generate a response.

• AI outputs may be inaccurate or incomplete.
• You are responsible for reviewing AI outputs before you rely on them or share them.
• AI features are optional and are not a substitute for your professional judgment.

13. Third-Party Services

DogRecords uses third-party services to operate, including authentication, payments, hosting, email, maps, calendar, and optional AI features. Those providers have their own terms and privacy policies, which apply to their services.

14. Service Availability and Disclaimers

DogRecords is provided "as is" and "as available," without warranties of any kind, to the fullest extent allowed by law. We do not guarantee that the service will be uninterrupted, error-free, or fit for a particular purpose.

15. Limitation of Liability

To the fullest extent allowed by law, DogRecords is not liable for indirect, incidental, special, consequential, lost-profit, or punitive damages, or for loss of data, arising from your use of the service.

Our total liability for any claim will not exceed the amount you paid us for DogRecords in the 12 months before the claim, or $20 if you have not paid us. Some places do not allow these limits, so they may not apply to you.

16. Indemnification

You agree to defend and indemnify DogRecords against claims, damages, and expenses arising from your content, your use of the service, your communications with clients, or your training services, except to the extent caused by our willful misconduct.

17. Service Changes

We reserve the right to change DogRecords features, pricing, or subscription terms, subject to applicable notice requirements.

• We may add, modify, or discontinue features of the service.
• We may change the monthly subscription price or other subscription terms.
• Where notice is required under applicable law or these Terms, we will provide that notice, including by email.
• Price or subscription-term changes take effect in later billing periods after notice, unless the notice states a different effective date.
• If you do not agree to a change, you may cancel your subscription as described in Cancellation. Continued use of the service after a change takes effect constitutes acceptance of the change.

18. Suspension and Termination

You may cancel your subscription or delete your account as described in Cancellation. We may suspend or terminate access if you violate these Terms, if required by law, or to protect DogRecords, our users, or others.

After a subscription ends, the account may become restricted as described above. After you delete your account, we delete associated records as described in the Privacy Policy.

19. User Feedback

By submitting feedback, you grant DogRecords a non-exclusive, royalty-free license to use it to operate and improve the service.

20. Dispute Resolution

Any dispute arising from these Terms or your use of DogRecords will be resolved by binding individual arbitration under Puerto Rico and U.S. law, except that either party may bring an individual claim in small-claims court.

You and DogRecords waive the right to participate in a class action or class arbitration. If this arbitration provision is found unenforceable, the dispute will be heard in the courts of Puerto Rico.

21. Force Majeure

We are not responsible for failures due to causes beyond our reasonable control.

22. Updates to These Terms

We may update these Terms from time to time. The current version is the one posted on this page, and the effective date at the top shows when it took effect. If we make material changes, we will notify users, including by email. Continued use of DogRecords after an update takes effect constitutes acceptance of the updated Terms.

23. General

• These Terms, together with the Privacy Policy, are the entire agreement between you and DogRecords about the service.
• If a provision is found unenforceable, the remaining provisions stay in effect.
• Our failure to enforce a provision is not a waiver of our right to enforce it later.
• We may assign these Terms. You may not assign them without our prior consent.

24. Legal Jurisdiction

These Terms are governed by the laws of Puerto Rico and the United States, without regard to conflict-of-law rules.
